These Terms & Conditions apply to all garden design services provided by The Palette Gardener. By booking a service, you agree to the terms outlined below.

1. About the Service

The Palette Gardener provides residential garden design services, including layout plans, planting plans, consultations, and related design advice.

All designs are bespoke and tailored to the client’s site, brief, and agreed scope of work.

2. Booking & Payment

  • A booking is confirmed once the agreed deposit has been paid.
  • Payment is made in staged instalments, beginning with a deposit to secure the booking. Further payments are due at agreed points during the design process, with the final balance payable upon delivery of the completed design.
  • Prices are confirmed in advance and relate only to the agreed scope of work.

Work will not commence until the deposit has been received.

3. Design Scope & Additional Work

The scope of work will be clearly outlined before the project begins.

Any work requested outside of the agreed scope — including additional design options, revisions beyond those included, or changes to the brief — may be charged separately and agreed in advance.

4. Revisions

  • The Garden Design Package includes a reasonable number of revisions, as agreed at the outset.
  • Further revisions or changes to the brief may incur an additional fee.

5. Cancellations & Rescheduling

  • Cancellations or rescheduling requests should be made as soon as possible.
  • Deposits are non-refundable once work has commenced.
  • Where possible, reasonable efforts will be made to reschedule bookings with sufficient notice.

6. Planting Plans & Availability

Planting plans and plant lists are prepared with care and professional knowledge.

Please note:

  • Plant availability can vary due to seasonality, nursery stock, and supplier availability.
  • Substitutions may be required when sourcing plants.
  • Final plant performance depends on site conditions, maintenance, and aftercare.

7. Implementation & Contractors

The Palette Gardener is not responsible for the work of third-party contractors, landscapers, or suppliers.

Where recommendations are made, these are provided in good faith, but any contract for implementation is strictly between the client and the contractor.

8. Additional Services

The Palette Gardener may offer additional services including, but not limited to:

  • Plant sourcing and supply
  • Planting services
  • Ongoing or seasonal maintenance

These services are optional and will be quoted separately where applicable.

Any additional services agreed will be subject to these Terms & Conditions unless otherwise confirmed in writing.

9. Intellectual Property & Use of Designs

All designs, drawings, and documents remain the intellectual property of The Palette Gardener until full payment has been received.

Once paid in full:

  • The client is granted permission to use the design for the agreed site only.
  • Designs may not be reused, shared, or reproduced for other sites without written permission.

10. Photography & Marketing

The Palette Gardener may request permission to photograph completed projects for portfolio and marketing purposes. Client privacy will always be respected.

11. Liability

The Palette Gardener will not be held liable for:

  • Issues arising from construction, planting, or maintenance carried out by others
  • Changes to site conditions after the design has been completed
  • Failure to follow the design as specified

Nothing in these terms affects your statutory rights.

12. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.
